Terms of Service

By accessing and using Digitalwiz services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Digitalwiz provides digital marketing services including but not limited to:

• Website development and design
• Search engine optimization (SEO)
• Pay-per-click advertising (Google Ads, Facebook Ads, etc.)
• Lead generation campaigns
• Digital marketing consultations

Services are provided subject to availability and may be modified, suspended, or discontinued at our discretion.

Payment terms include:

• Project payments: 50% deposit required to begin work, balance due upon completion
• Monthly services: Payment due in advance on the 1st of each month
• Setup fees: Due with first payment
• Late payments may incur a 1.5% monthly service charge
• Non-payment may result in service suspension

Clients are responsible for:

• Providing accurate information and materials needed for services
• Timely response to requests for feedback or approvals
• Compliance with all applicable laws and platform policies
• Maintaining access to necessary accounts (website, advertising platforms, etc.)
• Payment of invoices according to agreed terms

Upon full payment, clients own the final deliverables created specifically for their project. However, Digitalwiz retains rights to:

• General methodologies, processes, and know-how
• Pre-existing intellectual property
• The right to showcase work in our portfolio (unless confidentiality is agreed upon)

While we use industry best practices and work diligently to achieve desired outcomes, we cannot guarantee specific results from digital marketing efforts. Results depend on many factors including market conditions, competition, and client cooperation.

Both parties agree to maintain confidentiality of proprietary information shared during the course of the business relationship. This includes business strategies, financial information, and other sensitive data.

Services may be terminated by either party with 30 days written notice, except:

• One-time projects continue until completion unless terminated for cause
• Immediate termination for breach of contract or non-payment
• Upon termination, client is responsible for all charges incurred through the termination date

Digitalwiz's liability is limited to the amount paid for services in the 12 months prior to the claim. We are not liable for indirect, incidental, or consequential damages including lost profits or business interruption.

Any disputes arising from these terms or our services will be resolved through binding arbitration in North Carolina, USA, under the rules of the American Arbitration Association.
